As far as a retirement plan protecting your assets, for the individual that established the plan, an IRA or a 401(k). Those are creditor protected into that individual. However, when we leave those assets to a non-spouse, to beneficiaries, to children, they lose that creditor protection, and that's a lot of the key planning that we need to take into account. So, if a client's goal and objective is to not only protect their assets into them, but also into their beneficiaries, then we have to take the time to specifically analyze the asset and make sure it's passing to that beneficiary in a creditor protected way.
